ARRAIGNMENT
FOR DULEY
Most
of Duley's family and friends came in together with sunglasses
over their eyes, sitting on the front row waiting for Duley
to make her appearance in front of dozens of cameras and
spectators. Wearing shackles and carrying a cloth in her hands,
Duley slowly made her way in front of the Magistrate along with
her defense attorney, Carl B. Grant.
She
answered questions slowly and tearfully when asked if she understood
the charges brought against her - two counts of murder. Duley
admitted to investigators Monday evening that she suffocated her
two young sons, strapped them into their car seats, and allowed
her vehicle to become submerged in the Edisto River off of a boat
landing on Shillings Bridge Road in an attempt to stage an accident
to cover her crime.
After
her exit, Grant candidly spoke to members of the press outside of
the complex, stating that if a bond hearing had been held today,
Duley would plead not guilty. He has not seen her written
confession from Monday. Even with all of the extensive press
coverage around the investigation, Grant still believes Duley will
receive a fair trial in Orangeburg County.
Psychiatric
evaluations still have not been completed on Duley.

Here
is what you want to know, to sum up the press conference:
Part
of his initial statement: “At the conclusion of our lengthy evening
on last night, the determination or the statement was made by the
mother that she had suffocated the children and of course the children
were dead when they was place into the water. She has given that
statement to that effect and of course we are working the investigation
as being reported by being the recipient of statement from the mother,
now defendant of murder, which we have this morning served two warrants
of murder against Ms. Duley.”
Ms.
Duley checked into the Trump's Inn the day of the incident, suffocated
the two young children by placing her hand over them, then placed
them in their child safety seats in the car before heading to the
boat landing off of Shillings Bridge Road.
Sheriff
Williams went on to describe Ms. Duley. “She was a mother that was
unemployed. She had no means of taking care of her children. She
lived with her mother. And her mother was, I guess, a very firm
individual and believed in values from what we can determine. And
she often talked with her daughter about…maybe being a more of a
mother. Being more reliable, I guess, in a way. And of course, the
day before, the night before, the kids were placed at the river,
there was a disputed between the mother and Ms. Duley. And we believe
this is a direct response from Ms. Duley. I believe she was fed
up with her mother telling her she couldn't take care of the children
or she wasn't taking care of the children, and she just wanted to
be free. And we believe that her thoughts were ‘for me to be free
and for me to do what I wish to do, whatever that may be, if I didn't
have the children, I'll get rid of them.' …that is what our theory
is.”
Duley's
arraignment is scheduled for Wednesday at 2pm. Charges are two counts
of murder.
